Suspected club gunman arraigned | News, Sports, Jobs - Youngstown Vindicator

YOUNGSTOWN — Brothers of Power Classic Cars Club on Logan Avenue has a bright orange notice posted on its window, warning “Do Not Enter.”

The notice appeared Tuesday — the same day officials arrested the suspected gunman in the early-Sunday triple homicide at the club.

It indicates that the club is shut down for violations of “general property maintenance,” and no one is allowed to enter. It states the order to vacate is based on “unsafe conditions per fire chief” and city officials.

The shootings at the club brought attention to the building, now slated for demolition by the city. Fire Chief Barry Finley will not have firefighters go in there, Law Director Jeff Limbian said.

The bar is described as having multiple holes in the walls and roof and buckling wood in the basement holding up the structure.

The building’s caretaker, who was living in a second-floor apartment, was ordered to leave.

The city is also looking into whether the club violated liquor license laws. An Ohio Department of Liquor Control spokesman said there’s no record of the club having a license or for there being any liquor license for the 1532 Logan Ave. address where it is located. Attempts to call phone numbers associated with the owner of the club have been unsuccessful.

IN COURT

On Wednesday, alleged gunman Robert L. Shelton, 44, was arraigned via video in Youngstown Municipal Court from the Mahoning County jail. He did not have to enter a plea to charges of aggravated murder and being a felon in possession of a firearm.

Judge Carla Baldwin agreed with the recommendation of James Vivo, assistant Youngtown law director, and set Shelton’s bond at $1 million.

Shelton, 44, and Baldwin were cordial in their brief interactions. “Good afternoon, Mr. Shelton,” the judge said.

“How are you doing, ma’am?” he replied.

“I’m doing well. Thank you. I am now going to hear from the state of Ohio on bond,” she said.

“Due to the nature of the offense and the history of this defendant, the state is going to ask for a million dollar bond,” Vivo said.

“Bond will be set at $1 million,” the judge said.

She warned Shelton that if he is going to hire his own attorney, the attorney needs to be ready to attend a preliminary hearing within the next 10 days. Shelton had no attorney during Wednesday’s arraignment.

Shelton is accused of shooting to death Dymond D. Ortello, 34, only 30 to 40 feet from two Youngstown police officers who had arrived outside of the club just after the first 911 call at 3:45 a.m. Sunday.

Ortello was one of three men who died, with two others having shot each other inside the club, police said. They are Ortello’s brother, Daniel Ortello, 31, and Charles Pullen, 37. A man and woman were injured by gunfire inside the club but are expected to survive.

Shelton was charged by the Ohio State Highway Patrol with felony drug possession Jan. 16, so he was also arraigned on that charge Wednesday. His most recent Mahoning County felony offense was in 2006, when he was sentenced to two years in prison on cocaine-possession, but he also had felony convictions in the 1990s, according to court records.

A woman who police say harbored Jackson in an apartment in Liberty Township apparently was not arraigned Wednesday but is in the Mahoning County jail.

Jasmine Jackson, 24, was taken into custody Tuesday on a warrant out of Struthers Municipal Court. Authorities said they expect to charge her with obstructing justice.

She lied to U.S. marshals when they entered a Liberty Township apartment Tuesday and asked her about Shelton’s whereabouts. She “will be charged accordingly after the prosecutor reviews the circumstances,” Youngs-town police Chief Robin Lees has said.
